Schiff Could Face Fines, Prison Time if Classified Leak Allegations Proven

A Democrat whistleblower’s claims, reportedly supported by newly declassified FBI interview reports, could jeopardize the political career of Sen. Adam Schiff (D-CA). The whistleblower, a longtime Democratic staffer on the House Intelligence Committee, alleges that Schiff authorized the leaking of classified intelligence during the Trump–Russia investigation to damage then-President Donald Trump. According to Just The News, the whistleblower told the FBI as early as 2017 that Schiff instructed staff to leak derogatory information about Trump, supposedly saying it would be used to “indict” the president. The whistleblower claims he objected, calling the plan “unethical and possibly treasonous,” but was told they would not be caught. He also alleged Schiff expected to be appointed CIA Director if Hillary Clinton had won the 2016 election and identified Rep. Eric Swalwell (D-CA) as a potential intermediary for the leaks.

After reporting the matter to the FBI, the whistleblower says he was fired and that bureau leadership, including Director Christopher Wray, failed to act. He reportedly repeated the allegations to the FBI’s St. Louis office in 2023, again without response. Former U.S. Attorney Brett Tolman warned that if prosecutors pursue the case and the allegations prove true, Schiff could face severe legal consequences. Tolman explained that each count of leaking classified information can carry a $250,000 fine and possible prison time, depending on the intent and context of the leaks. If proven to have aimed at undermining the United States, related conspiracy or interference statutes could lead to sentences of up to 20 years.

Critics argue the FBI’s inaction reflects a broader pattern of protecting politically connected figures. Kash Patel, a former Trump official, has echoed that view, accusing the bureau of shielding allies while targeting opponents. Schiff has not publicly responded to the new claims but has previously denied leaking classified material, dismissing similar accusations as partisan attacks.
