The lawmakers allege Smith\u2019s actions violated constitutional protections and could warrant <strong>disbarment<\/strong>, according to <em>The New York Post<\/em>.<\/p>\n<p>The letter claims that during Smith\u2019s Trump-related probe, the <strong>Biden DOJ<\/strong> issued subpoenas to multiple telecommunications companies in 2023, secretly obtaining the <strong>cell phone records<\/strong> of Republican members of Congress. \u201cWe have yet to learn of any legal predicate for the Biden Department of Justice issuing subpoenas to obtain these cell phone records,\u201d the lawmakers wrote. Reports suggest Smith\u2019s team conducted what\u2019s known as a <strong>toll analysis<\/strong>, gathering call metadata, recipient details, and location information from lawmakers\u2019 personal devices\u2014without notifying or obtaining consent from those targeted.<\/p>\n<p>Joining Blackburn in the referral were <strong>Sens. Lindsey Graham, Tommy Tuberville, Dan Sullivan, Ron Johnson, Bill Hagerty, Josh Hawley, Cynthia Lummis<\/strong>, and <strong>Rep. Mike Kelly<\/strong>. The lawmakers argue Smith\u2019s actions breached the <strong>Speech or Debate Clause<\/strong>, which protects Congress from executive overreach. \u201cThe conduct that Jack Smith and his team engaged in harkens back to a dark chapter in American history\u2026 we must ensure we never return to these disgraceful eras,\u201d the letter stated, comparing the actions to abuses under <strong>J. Edgar Hoover<\/strong> and the prosecution of <strong>Sen. Ted Stevens<\/strong>. They also cited the <strong>FBI\u2019s Arctic Frost operation<\/strong>, which reportedly fed data into Smith\u2019s <strong>election interference case<\/strong> against Trump.
